Contest rules “FairyTrees2025” – INSTAGRAM

§ 1 General provisions

These Terms and Conditions set out the rules, scope, and conditions of the “FairyTrees2025” contest (hereinafter: “Contest”) organized by JKB GROUP SP. Z O.O., ul. Boczna 4a, 66-016 Czerwieńsk, NIP 9731064410, KRS 0001023240, REGON 383330918. The Contest is organized in accordance with Polish law, which shall be the sole applicable law.

The Contest will take place on Instagram at https://www.instagram.com/fairytreesde.

The Contest is organized by JKB GROUP SP. Z O.O., ul. Boczna 4a, 66-016 Czerwieńsk. Activities related to technical support and selection of Contest winners are carried out by the Organizer. The Contest will be held from November 16, 2025 (from the time of publication of the contest post) to January 6, 2026.

The contest is not sponsored, administered, or organized by Instagram. Instagram is not responsible for the contest. Any questions, comments, complaints, or claims related to the contest should be directed to the organizer, not to Instagram.

The Organizer agrees to hold Instagram harmless from any claims made by Contest Participants in connection with this Contest.

§ 2 Contest participants

Any natural person (hereinafter: “Participant”) may participate in the Contest who:

is resident in the European Union,
is of legal age or has the consent of a legal representative to participate in the Contest,
is not affiliated with the Organizer in any way, whether personally, financially, or organizationally,
has previously purchased a FairyTrees Christmas tree and holds proof of purchase or an order number,
has a public account on Instagram,
added @fairytreesde to “followed”,
has read the Contest Rules and accepts its provisions,
completed the Contest Task.

Failure to meet any of the conditions listed in points 1–8 above shall result in the Participant’s exclusion from the Contest. If such circumstances are discovered after a prize has been awarded, the Organizer reserves the right to demand the return of the prize.

§ 3 Contest task and prizes

The contest task consists of:

publishing a photo or short video (reel or story) created by the Participant, showing the Participant, a family member, or a pet together with a FairyTrees Christmas tree, on the Participant's private Instagram profile by 11:59 p.m. on January 6, 2026. The photo/reel must be tagged with the hashtag #fairytrees2025 and @fairytreesde. The contestant must also post an answer to the question: “What is your most beautiful memory with a Christmas tree in the background?” under the post announcing the contest on the FairyTrees Instagram profile published on November 16, 2025. To participate in the contest, you must follow the @fairytreesde page.

Completion of the Contest Task is tantamount to the Participant's acceptance of the provisions of the Rules and Regulations without the need to make separate statements in this regard, and is tantamount to the Participant (or, in the case of a Participant who is a minor or does not have full legal capacity – by their legal representative) of the following statements and commitments:

The Contest Task is a manifestation of the Participant's individual and original creativity.
The participant has all rights to the submitted work, and these rights are not limited or encumbered in any way in favor of third parties. The Contest Task represents only the Participant and the Participant consents to the dissemination of his/her image for purposes related to the Contest. If the Contest Task contains images of other persons, they have given the Participant their express consent to use their image for purposes related to the Contest.
Use of JKB GROUP SP. Z O.O., ul. Boczna 4a, 66-016 Czerwieńsk, NIP 9731064410, KRS 0001023240, REGON 383330918 from the Contest Task in accordance with the Contest Rules will not threaten or violate anyone's rights, property, or legally protected secrets.
The Participant agrees that the submitted entry may be used for the purpose of promoting the FairyTrees brand, including by reposting it on Instagram. The participant grants JKB GROUP SP. Z O.O a non-exclusive license to use the Contest Task in connection with the Contest. The license is granted without territorial restrictions, for a period of 5 years from the date of posting the Contest Task on Instagram, within the scope of copyrights for the use of the Contest Task in connection with the Contest. The license is granted for the fields of public marketing, exhibition, reproduction, display, broadcasting, rebroadcasting, making available at a selected place and time (on the Internet), using the Contest Task for promotional or advertising purposes, and permission to create and exploit adaptations of the Contest Task, combining it with other goods.
JKB GROUP SP. Z O.O has the right to grant sublicenses.
The participant undertakes not to exercise their moral rights in relation to the Contest Task against JKB GROUP SP. Z O.O.
JKB GROUP SP. Z O.O may request the winner to conclude an appropriate written agreement for the transfer of all copyrights to the Contest Task.
The Organizer reserves the right to remove and exclude from the Contest any Contest Tasks:
that violate Instagram's terms of service,
that do not meet the criteria specified in the Regulations or have been submitted in violation of the Regulations,
containing content that is contrary to good manners, immoral, offensive, or violates applicable laws,
violating rights, including in particular copyrights or personal rights of third parties, including the unlawful use of images of third parties,
containing logos or advertising content relating to any goods or services other than Fairytrees.

The Organizer will select three entries whose accompanying answers are judged the best and will award prizes as follows:

first place: 1000 €
second place: €500
third place: €300

Winners will be notified of their win by January 24, 2026, via a private message sent on Instagram. In order to receive the prize, winners must send a private reply message by January 28, 2026, including their first and last name, mailing address (street, house number, postal code, city), bank account, and a scan of the purchase confirmation/order number confirming the previous purchase of a FairyTrees product. Prizes will be sent to winners by bank transfer by February 28, 2026. The organizer reserves the right not to justify the selection of photos

§ 4 Processing of personal data

The administrator of personal data collected during the Contest is JKB GROUP SP. Z O.O., ul. Boczna 4a, 66-016 Czerwieńsk. Contest Participants consent to the processing of their personal data for purposes related to the organization and administration of the Contest. The personal data of Contest Participants will be collected and processed in accordance with the provisions of the Act of May 10, 2018, on the protection of personal data (Journal of Laws, item 1000), and Participants have the right to access, correct, and delete their data. Participants' data will not be transferred to other entities. Providing data is voluntary, but necessary for the Contest to be conducted.

§ 5 Complaint procedure

Any complaints or objections regarding the course of the Contest may be submitted by Participants in writing by registered mail to the Organizer's address no later than 7 (seven) days after the end of the Contest. The Participant will be informed about the manner in which the complaint will be considered by registered letter (unless the participant agrees to receive notification by electronic means only) within 7 (seven) days.

§ 6 Final provisions

The Contest Rules are available on the Fairytrees website in the “Contest” tab and at the Organizer's headquarters. A summary of the rules of the Contest may be found on the Organizer's website. All content of this nature is for informational purposes only. Only the provisions of these Rules and applicable law are legally binding. The Organizer reserves the right to amend these Contest Rules, provided that such amendments do not infringe upon the rights already acquired by Participants.

In the event of any provision of these Terms and Conditions being amended or invalidated by a decision of a competent authority or court, the remaining provisions shall remain in force and shall be binding on the Organizer and the Participant.
